Terms of service
These terms govern your use of the website pxlmonk.com and of the PxlMonk desktop application, both provided by SynthScript, Owner: Christoph Kretschmer, Hornisgrindestraße 9, 77855 Achern, Germany (“we”, “us”, “PxlMonk”).
1. Scope
By visiting this website or installing and using the PxlMonk application, you agree to these terms. If you do not agree, please do not use the website or the application.
2. The Website
This website provides information about PxlMonk and a contact form. It does not process payments. Purchases, trial licences and your licence details are handled by our licence service at licences.pxlmonk.com.
3. Buying PxlMonk
PxlMonk is sold by Paddle.com Market Limited as Merchant of Record. Paddle, not SynthScript, is your contracting party for the purchase: Paddle operates the checkout, collects the payment, issues the invoice and accounts for VAT in the relevant country. Paddle’s own buyer terms apply to the purchase transaction; these terms govern your use of the software. You enter your payment details with Paddle; they are not transmitted to us.
The price is 129 € including VAT as a one-time payment. Billing is in euro regardless of your country of residence; the applicable VAT is already contained in that amount and is not added on top. The final amount is shown to you at checkout before you commit.
4. Software Licence
On purchase we grant you a non-exclusive, non-transferable right to install and use the application for your own personal or professional photo-editing purposes. The licence is perpetual — it does not expire — and may be used on up to three computers at the same time.
The purchase additionally grants a period of twelve months from the date of purchase in which every newly released feature is unlocked for you. Once a feature has been unlocked, it stays unlocked permanently.
New program versions and bug fixes are provided to you permanently and independently of this, that is, also after those twelve months have elapsed. Features first published after the period has elapsed are contained in the delivered version but are disabled. Extending the period by a further twelve months for 99 € is optional and is not required to keep using the software.
There are no graduated tiers and no free edition with a reduced feature set: at the time of purchase the licence covers the complete application. Access to features released later is governed solely by the period described above.
You may not decompile, reverse-engineer, redistribute, sublicense, or resell the application itself, except to the extent such restrictions are not permitted by applicable law.
PxlMonk uses a number of third-party open-source libraries, each under its own license (for example LibRaw, licensed LGPL with dynamic linking, and other MIT/Apache/public-domain components). A full list of third-party licenses is included with the application itself.
5. Trial Licence
PxlMonk can be used free of charge for 30 days with the full feature set. The trial licence is requested from inside the application, not through this website. It requires no payment details and no password. One trial licence is issued per email address and per computer.
6. State Without an Active Licence
As long as no licence has been activated, after a trial licence has expired, and after a licence has been withdrawn following a refund, the application continues to run without a licence. Your catalog, images, existing edits, ratings and albums remain accessible and visible, and new files can be imported.
In this state, export is limited to the unedited original files. New edits and the export of edited versions are locked. No data is deleted or hidden; with an active licence all edits are available again unchanged.
7. Licence Validation
The application contacts our licence service at licences.pxlmonk.com when you request a trial licence, when you activate a licence, and on each start, in order to retrieve the signed revocation list and re-register the computer. This is a necessary part of the licensed use of the software and is not optional. No image data, catalog data, edits or metadata are transmitted. Details of what is processed are set out in our privacy policy.
8. Refunds
We offer a voluntary fourteen-day refund from the date of purchase, without requiring a reason. Refunds are processed by Paddle as the seller. The full conditions, including how renewals are treated and how this relates to your statutory right of withdrawal, are set out in our refund policy.
9. Your Content
Editing takes place on your own device. Your photos, edits, and catalog data remain on your device; we do not receive, store, or claim any rights in your photos or the images you create with the application.
10. Availability and Warranty
Information on this website about the product (features, screenshots, pricing) is provided on a best-effort basis and without warranty of completeness. The application’s own licence terms and documentation take precedence for the shipped product. Your statutory rights in the event of defects remain unaffected.
11. Limitation of Liability
We are liable without limitation for intent and gross negligence, and for damages resulting from injury to life, body, or health. For simple negligence, we are only liable for breach of a material contractual obligation (cardinal obligation), and in that case limited to the foreseeable, typically occurring damage. Liability under the German Product Liability Act remains unaffected.
12. Changes to These Terms
We may update these terms from time to time, for example as the product changes. The version published on this page is always the current one.
13. Governing Law
These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods, without prejudice to any mandatory consumer protection provisions of your country of residence.
